Terms of Service
Last updated: on publication. Operator: [[OPERATOR_LEGAL_NAME]], registered at [[REGISTERED_ADDRESS]] ("we", "the Operator").
By using TxtU (the "Service") or creating an account, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, do not use the Service.
1. What the Service is
The Service provides phone numbers that receive SMS messages, in two forms:
- Public (shared) numbers: available to any visitor. Every message sent to a public number is displayed publicly to anyone, with no privacy whatsoever.
- Private (rented) numbers: assigned to one customer for a paid, fixed period, during which no other customer can see that inbox.
The Service does not provide voice calls, outbound messaging, number portability, or any other regulated telecommunications service.
2. Eligibility
By using the Service you represent and warrant that you:
- Are at least 18 years old and have full legal capacity to contract.
- Are not a person or entity subject to international sanctions, nor resident in a comprehensively embargoed territory.
- Will not use the Service for any purpose unlawful in your country or in the Operator's jurisdiction.
3. Your account
- You are solely responsible for the confidentiality of your credentials and for all activity under your account.
- Your information must be accurate and current. Supplying false information is a material breach of these Terms.
- Creating multiple accounts to evade a ban or a usage limit is prohibited. We use device fingerprinting and network signals to detect this (see clause 8 and the Privacy Policy).
- Accounts may not be transferred, sold or shared.
4. Acceptable use
Your use is governed by the Acceptable Use Policy, which forms an integral part of these Terms. Any breach of it is a breach of these Terms.
You expressly acknowledge that you will not use any number obtained from the Service for:
- impersonating another person, or circumventing any third party's identity-verification process;
- financial fraud, money laundering, or financing unlawful activity;
- harassing, extorting, threatening or stalking any person;
- any activity criminalised under applicable law.
5. No privacy on public numbers
Public numbers are shared and public by design. Any message they receive — including verification codes, links and personal data — is published to every visitor and may be indexed by search engines. Do not use a public number for any account or service you care about. The Operator accepts no liability for any resulting harm.
6. Private numbers (rental)
- A purchase grants a temporary right of use, not ownership; you acquire no proprietary right in the number.
- The period begins when payment is confirmed and ends automatically on expiry. After expiry the number may return to circulation, and a subsequent renter may see messages that arrive after your period ends.
- We do not guarantee deliverability from any particular provider; many services block numbers of this category, which is outside our control and does not entitle you to a refund.
- You may not resell, sublet or otherwise make the number available to others.
- We may terminate a rental immediately and without refund upon breach of these Terms or the Acceptable Use Policy.
7. Payment
- Prices are shown in the currency stated at purchase and include only what is expressly stated.
- Payments are processed by third-party providers whose own terms also apply to you.
- Refunds are governed by the Refund Policy.
- Initiating a chargeback without first contacting us is a breach of these Terms and will result in suspension.
8. Monitoring and logging — your express consent
You expressly consent to the Operator collecting and retaining, for each registration, sign-in, purchase and inbox access:
- your IP address, the country inferred from it, and the network operator (ASN);
- a technical fingerprint of your device and browser (screen, timezone, languages, graphics and font characteristics);
- signals indicating use of a VPN, proxy or anonymising network;
- payer details as supplied by the payment provider (name, email, country, account identifier);
- the record of numbers rented, their periods, and the messages delivered to you with their timestamps.
Purpose: preventing fraud and abuse, protecting third parties, and responding to lawful requests. Full detail, legal bases and retention periods are in the Privacy Policy.
9. Suspension and termination
We may, without prior notice and at our sole discretion, suspend, ban or terminate any active rental if:
- you breach these Terms or the Acceptable Use Policy;
- we receive an abuse report or an official request concerning your activity;
- we suspect fraud, impersonation, or evasion of a previous ban.
In cases of serious breach no refund is due, and we may retain and disclose your records under clause 11.
10. Reporting abuse
If you have been harmed by the use of one of our numbers, contact [[ABUSE_EMAIL]] or use the reporting form on the site. We commit to reviewing every substantive report and taking appropriate action, including disabling the number, banning the account, and preserving evidence.
11. Cooperation with authorities
We respond to valid legal requests from competent authorities under our Law Enforcement Response Policy. This may include disclosure of all data listed in clause 8. You acknowledge that you have no reasonable expectation of privacy in that data as against a valid legal request.
12. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranty of any kind, express or implied, including fitness for a particular purpose, continuity, freedom from error, or delivery of any message. We do not guarantee the availability or continuity of any number.
13. Limitation of liability
To the maximum extent permitted by law:
- The Operator is not liable for indirect, consequential, special or punitive damages, nor for lost profit, lost data, or loss of access to a third-party account.
- Our total liability to you, on any basis, will not exceed the amount you actually paid the Operator in the three months preceding the event.
- We bear no liability for any act committed by you or by anyone else using a number obtained from the Service.
14. Indemnity
You agree to indemnify, defend and hold harmless the Operator, its personnel and service providers from any claim, action, penalty, investigation or cost (including reasonable legal fees) arising out of or connected with:
- your use of the Service or of any number obtained from it;
- your breach of these Terms or the Acceptable Use Policy;
- your breach of any law or of any third party's rights.
This obligation survives the end of your relationship with the Service.
15. Changes to these Terms
We may update these Terms. Every version is retained with its date and a cryptographic hash of its exact wording. When a new version requiring acceptance is published, you will be asked to accept it before continuing to use the Service, and you remain bound by the version you accepted until you accept the new one.
16. Governing law
These Terms are governed by the laws of [[JURISDICTION]], whose courts have exclusive jurisdiction over any dispute arising from them.
17. General
- If a clause is held invalid, the remainder stays in force.
- Our waiver of a right on one occasion is not a waiver of it in future.
- These Terms together with the policies referenced form the entire agreement between us.
